Land Acquisition Responsibilities

• · Acquisition of Private Land: Acquiring private land within the division for various projects implemented by the government and local authorities.
• · Compensation and Interest Payments: Facilitating the payment of compensation and interest for the acquired land.
• · Issuance of Certificates: Issuing certificates under Section 44 of the Land Acquisition Act for the acquired land parcels. These certificates are then sent to the Land Registrar's office for registration and subsequently provided to the acquiring agencies

Land Acquisition Process - Acquisition Under the Normal Procedure

1. Acquisition Proposal: The requesting institution submits the acquisition proposal through its Ministry.
2. Section 2 Order: The Ministry of Land grants authority to enter the land, and the Minister decides that the land is required for a public purpose.
3. Section 2 Notice: The Divisional Secretary publicizes the notice of the proposed land acquisition in the vicinity of the land.
4. Preliminary Plan Preparation: This is carried out by the Surveyor General.
5. Section 4 Order: The Minister of Land decides to call for and examine objections from the landowners.
6. Section 4 Notice: The Divisional Secretary publicizes the notice inviting objections.
7. Objection Inquiry: The requesting Ministry holds an inquiry and submits its recommendations.
8. Section 5 Declaration: The Minister decides to acquire the land.
9. Gazette Notification Under Section 50: The Divisional Secretary and the Government Printer publicize through the Gazette that the Minister of Land has decided to acquire the land.
10. Final Plan: This is prepared by the Surveyor General.
11. Section 7 Gazette Notice: The Divisional Secretary and the Government Printer publish a notice in the Gazette calling for an inquiry into the ownership of the land.
12. Section 9 Title Determination: The Divisional Secretary conducts the title inquiry.
13. Section 10 Title Determination: The Divisional Secretary makes a decision on the land title.
14. Valuation: This is carried out by the Government Valuation Department.
15. Section 17 Award of Compensation: The Divisional Secretary awards compensation.
16. Compensation Payment: The Divisional Secretary secures funds from the Ministry of Land or the relevant institution and pays the compensation to the owner.
17. Section 38 Order Gazette Notification: The Ministry of Land takes possession of the land.
18. Taking Over Unencumbered Possession: The Divisional Secretary takes possession of the land and hands it over to the requesting institution.
19. Section 44 Vesting Certificate: After paying compensation, the Divisional Secretary issues the vesting certificate to the relevant institution.

5. Urban Development Authority Transfers: Handling government land matters, including transfers under Section 6(1) of the Urban Development Authority Act.

6. Government Land Leases: Managing various types of leases for government land, including long-term leases, annual leases, and productive leases.
